LEGAL DRAFT — NOT PUBLISHED
Do not publish before validating the following elements: operational email address, designated consumer mediator, usable return address, any applicable EPR identifiers, and actual functionality of the online withdrawal form receipt confirmation.
Last draft update: September 24, 2026
1. Identification of the seller
These General Terms and Conditions of Sale (hereinafter the "GTCS") are offered by Eva Millot EI, a sole proprietorship, operating the store under the name Nuvipil (hereinafter "Nuvipil" or the "Seller").
Business address: 4 Place de la Mairie, 30150 Roquemaure, France
SIRET: 108 497 298 00019
Intracommunity VAT number: FR64 108497298
Phone: +33 6 66 80 95 69
Email: contact@maboutique.fr
EPR Unique Identifier(s): TO BE VERIFIED AND COMPLETED IF APPLICABLE
2. Purpose and scope
These GTCS govern the sales of goods offered by Nuvipil to consumers acting for purposes that do not fall within the scope of their commercial, industrial, craft, liberal, or agricultural activity, when the order is concluded remotely via the Nuvipil online store.
They apply to any order placed in the delivery areas effectively offered during the ordering process. The essential characteristics of each product, its price, and, where applicable, delivery costs or restrictions are presented before the order is validated.
The Customer is invited to read these GTCS before placing an order. Their acceptance cannot have the effect of depriving the consumer of the mandatory legal provisions applicable to them.
3. Products and pre-contractual information
Nuvipil markets, among other things, rollers and brushes intended to remove pet hair, lint, and dust from the surfaces described for each product. The essential characteristics of each product are those presented on its product sheet at the time of the order.
The descriptions, photographs, dimensions, colors, and other elements presented on the site are intended to inform the Customer about the essential characteristics of the product. Slight differences in appearance related, in particular, to the screen, lighting, or manufacturing tolerances may exist where they do not affect the agreed essential characteristics. However, no presentation on the site shall reduce the Customer's rights in the event of a lack of conformity.
Before use on delicate textiles or sensitive surfaces, the Customer is invited to follow the product instructions and, when there is reasonable doubt, to perform a test on an inconspicuous area. This recommendation does not limit the legal warranties.
4. Price
The applicable prices are those displayed at the time of the order. They are indicated in euros and include applicable taxes when required by regulation. Any delivery costs, additional fees, or applicable discounts are brought to the Customer's attention before the final validation of the order.
Nuvipil may modify its prices for the future. A subsequent modification does not call into question the price of an order already validly concluded.
In the event of a manifest material pricing error, such as a price that is manifestly negligible relative to the value of the product and identifiable as an error, Nuvipil may inform the Customer before shipment and offer them either to confirm the order at the exact price or to cancel it with a full refund of any sums already paid. This clause does not allow for the arbitrary modification of a validly agreed price.
5. Ordering and formation of the contract
The Customer selects the desired products and variants, checks the contents of their shopping cart, provides the information necessary for the order, and may correct any errors before validation.
Before the conclusion of the contract, the Customer has access to essential information relating to the products, the total price, any costs, payment methods, delivery, warranties, and the right of withdrawal. The final validation of the order is carried out by means of a function indicating unambiguously that the order implies an obligation to pay.
After the order, a summary confirmation is sent to the Customer on a durable medium, subject to the accuracy of the email address provided.
Nuvipil may refuse or cancel an order for a legitimate reason, particularly in the event of fraud or attempted fraud, a manifest anomaly in the information provided, impossibility of payment, unavailability of the product, or a quantity manifestly incompatible with a consumer's usual needs. Any amount unduly collected following such a cancellation shall be refunded.
6. Product availability
Offers are valid as long as they are presented as available on the site, subject to any unavailability noted after the order. In the event of unavailability preventing the execution of the order, Nuvipil shall inform the Customer as soon as possible and refund the sums corresponding to the non-supplied product. No substitute product shall be imposed without the Customer's agreement.
7. Payment
The price is payable according to the payment methods offered to the Customer at the time of the order. The payment methods actually available may depend on the amount, the payment service provider, the country, or eligibility conditions indicated by the relevant provider.
The Customer guarantees that they are authorized to use the chosen payment method. Nuvipil may suspend the processing of an order when the payment is refused, canceled, reported as fraudulent, or is subject to an anomaly requiring legitimate verification.
Nuvipil does not directly store full banking data when payment is processed by a secure payment service provider.
8. Retention of title and transfer of risks
The products remain the property of Nuvipil until full payment of the price. This retention of title has no impact on the transfer of risks, which occurs in accordance with the mandatory rules of the Consumer Code, particularly when the Customer or a third party designated by them physically takes possession of the good, subject to specific cases provided for by law.
9. Delivery
Delivery is offered only to destinations for which a delivery method is effectively available during the ordering process.
The applicable date or delivery time is the one indicated to the Customer before the conclusion of the order and, where applicable, recalled in the order confirmation. In the absence of an agreed date or deadline, the good must be delivered without undue delay and at the latest thirty days after the conclusion of the contract.
In the event of a delay in delivery, the Customer benefits from the remedies provided by the mandatory provisions of the Consumer Code, particularly the possibility, when the legal conditions are met, to enjoin the Seller to perform the delivery within an additional appropriate period and then to terminate the contract if the delivery still does not occur, or to terminate the contract immediately in the cases provided for by law.
Nuvipil practices drop-shipping: products may be shipped directly by its suppliers. This does not change the identity of the seller or its full legal liability toward the consumer for the proper execution of the distance contract, subject to the causes of exemption provided for by law.
10. Receipt of the order
The Customer is invited to check the apparent condition of the package and the products upon receipt and to quickly report any anomaly, missing product, incorrect product, or damage observed to customer service, attaching photographs where useful to facilitate the processing of the file.
The absence of immediate reservations with the carrier does not deprive the consumer of their legal rights with respect to Nuvipil, particularly regarding the conformity of the good and the proper execution of the contract.
11. Right of withdrawal
For distance sales of goods, the consumer Customer generally has a legal period of fourteen days from the receipt of the good by themselves or by a third party other than the carrier designated by them, to notify their decision to withdraw without having to justify their decision.
When several goods in the same order are delivered separately, or when a good is composed of several lots or pieces delivered separately, the period runs from the receipt of the last good, lot, or piece under the conditions provided for by law.
The Customer may exercise their right by means of the form appearing at the end of these GTCS or any other unambiguous statement expressing their wish to withdraw.
TO BE VALIDATED BEFORE PUBLICATION: an online withdrawal functionality is present on the page "Renounce the contract here". Verify before publication that this functionality is visible, directly and easily accessible throughout the entire duration of the legal period, and that after each submission, the Customer actually receives, within a reasonable time, on a durable medium, an acknowledgment of receipt including their declaration as well as the date and time of its submission, in accordance with the rules in force since June 19, 2026. The mere display of a form and a promise of an acknowledgment is not sufficient to meet this requirement.
Legal exceptions to the right of withdrawal apply only when the conditions provided for by law are effectively met and the Customer has been informed of this before the order. No simple unpacking or testing reasonably necessary to appreciate the nature, characteristics, and proper functioning of an ordinary product removes, by itself, the right of withdrawal.
12. Return after withdrawal
After notifying their withdrawal, the Customer shall return or restore the good without undue delay and at the latest within fourteen days following the communication of their decision, unless Nuvipil offers to collect the good itself.
Unless covered by Nuvipil or in a case where the law imposes this cost on the Seller, the direct costs of return related to the exercise of the right of withdrawal are at the Customer's expense. The products must be correctly protected for transport.
The Customer is only liable for the depreciation of the good resulting from handling other than that necessary to establish its nature, characteristics, and proper functioning, when the legal conditions for this liability are met.
Final return address: TO BE CONFIRMED BEFORE PUBLICATION. Return instructions will be communicated in such a way as not to hinder the exercise of the right of withdrawal.
13. Refund in case of withdrawal
When the right of withdrawal is validly exercised, Nuvipil shall refund the sums due, including the standard delivery costs paid for the order in question, without undue delay and at the latest within fourteen days following the date on which Nuvipil is informed of the decision to withdraw.
For a sale of goods, Nuvipil may defer the refund until the goods are recovered or until the Customer provides proof of their shipment, the date retained being that of the first of these facts. The additional costs resulting from the Customer's express choice of a more expensive delivery method than the standard method offered do not need to be refunded.
The refund is made using the same means of payment as that used for the initial transaction, unless the Customer expressly agrees to another means that does not occasion costs for them.
14. Legal guarantee of conformity and guarantee against hidden defects
Legal box – legal guarantee of conformity and guarantee against hidden defects
The consumer has a period of two years from the delivery of the good to obtain the implementation of the legal guarantee of conformity in the event of the appearance of a lack of conformity. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date of its appearance.
When the contract for the sale of the good provides for the supply of digital content or a digital service continuously for a period exceeding two years, the legal guarantee is applicable to this digital content or digital service throughout the entire period of supply provided. During this period, the consumer is only required to establish the existence of the lack of conformity affecting the digital content or digital service and not the date of its appearance.
The legal guarantee of conformity entails an obligation for the professional, where applicable, to provide all updates necessary to maintain the conformity of the good.
The legal guarantee of conformity gives the consumer the right to the repair or replacement of the good within thirty days of their request, free of charge and without major inconvenience to them.
If the good is repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial warranty.
If the consumer requests the repair of the good, but the seller imposes the replacement, the legal guarantee of conformity is renewed for a period of two years from the date of the replacement of the good.
The consumer may obtain a reduction in the purchase price by keeping the good or terminate the contract by obtaining a full refund against return of the good, if:
- The professional refuses to repair or replace the good;
- The repair or replacement of the good occurs after a period of thirty days;
- The repair or replacement of the good causes a major inconvenience to the consumer, particularly when the consumer definitively bears the costs of taking back or removing the non-conforming good, or if they bear the installation costs of the repaired or replacement good;
- The lack of conformity of the good persists despite the seller's unsuccessful attempt to bring it into conformity.
The consumer is also entitled to a reduction in the price of the good or to the termination of the contract when the lack of conformity is so serious that it justifies an immediate price reduction or termination of the contract. The consumer is then not required to request the repair or replacement of the good beforehand.
The consumer is not entitled to the termination of the sale if the lack of conformity is minor.
Any period of immobilization of the good for repair or replacement suspends the warranty that remained to run until the delivery of the restored good.
The rights mentioned above result from the application of Articles L. 217-1 to L. 217-32 of the Consumer Code.
The seller who in bad faith hinders the implementation of the legal guarantee of conformity is liable to a civil fine of up to 300,000 euros, which may be increased to 10% of the average annual turnover (Article L. 241-5 of the Consumer Code).
The consumer also benefits from the legal guarantee against hidden defects in application of Articles 1641 to 1649 of the Civil Code, for a period of two years from the discovery of the defect. This guarantee entitles the consumer to a price reduction if the good is kept or a full refund against return of the good.
These legal guarantees apply independently of any commercial guarantee. Nuvipil cannot exclude them or reduce their scope.
To implement a legal guarantee, the Customer can contact Nuvipil at the contact details appearing in Article 1. It is recommended to specify the order number, the product concerned, and the difficulty encountered in order to facilitate processing, without any formality not provided for by law being able to condition the exercise of legal rights.
15. Liability and use of products
Nuvipil is liable under the conditions provided for by the legal provisions applicable to distance contracts, the conformity of goods, and product safety. No clause of these GTCS limits the mandatory rights of the consumer.
The Customer remains responsible for any use of the product contrary to the instructions provided, manifestly diverted from its purpose, or carried out after a modification of the product attributable to them, provided that this circumstance is indeed the cause of the damage or difficulty invoked.
When the law allows it, Nuvipil may be exonerated from all or part of its liability by proving that the non-execution or poor execution of the contract is attributable to the consumer, to the unforeseeable and insurmountable act of a third party to the contract, or to a case of force majeure.

18. Personal data
Personal data necessary for ordering, payment, delivery, after-sales service, and compliance with legal obligations are processed in accordance with applicable regulations. Detailed information regarding the purposes, legal bases, recipients, retention periods, and individual rights can be found in Nuvipil's privacy policy.
Data controller: Eva Millot. Requests regarding personal data may be sent using the contact details specified in the privacy policy.
19. Intellectual property
The original elements composing the Nuvipil site, notably texts, graphic designs, photographs for which Nuvipil holds the rights, distinctive signs, and editorial content, are protected by the rules applicable to intellectual property. Any reuse beyond the exceptions provided by law requires the authorization of the relevant rights holder.
This clause does not claim to grant Nuvipil any rights to content, trademarks, or elements belonging to third parties.
20. Promotions, discount codes, and commercial offers
Promotions and discount codes are subject to the conditions announced with the offer: validity period, any minimum purchase amount, eligible products or customers, and stacking rules. Unless a more favorable provision is announced, a promotional benefit is neither exchangeable for cash nor applied retroactively to an order already concluded.
Price reduction announcements are applied in accordance with the current legal rules regarding consumer information on prices.
21. Proof, electronic communications, and archiving
Order confirmations, invoices, electronic exchanges, and computer records kept under conditions ensuring their integrity may help establish the exchanges and transactions that have taken place between the parties, without depriving the consumer of the legal rules regarding evidence.
When a contract concluded by electronic means involves an amount equal to or greater than 120 euros, Nuvipil keeps the document recording it for the legal duration and guarantees access to it for the Client who requests it. This period is ten years from the conclusion of the contract if delivery is immediate; if not, it runs until delivery and then for ten years thereafter.
22. Extended Producer Responsibility (EPR)
VERIFICATION REQUIRED BEFORE PUBLICATION. When Nuvipil acts as a producer within the meaning of an extended producer responsibility scheme applicable to products or packaging placed on the French market, the unique identifier(s) required must be communicated in the T&Cs and on the site in accordance with environmental regulations. Applicable identifiers will only be added after verifying the obligation and obtaining the corresponding numbers.
23. Force majeure
The parties' obligations may be affected by an event meeting the legal conditions of force majeure. This clause applies without prejudice to the specific mandatory rules for consumer contracts, particularly those relating to delivery, reimbursement, and the liability of the professional at a distance.
24. Applicable law and dispute resolution
These T&Cs and the contracts concluded with Nuvipil are subject to French law, without prejudice to the more protective mandatory rules that would be applicable to the consumer under conflict of law rules.
In the event of a difficulty, the Client is invited to first send a complaint to Nuvipil. In the absence of an amicable solution, they may refer the matter to the competent consumer ombudsman once indicated above, and then to the competent courts according to the applicable legal rules. No clause in these T&Cs imposes on the consumer a jurisdiction that would be prohibited by the mandatory rules of territorial competence.
25. Amendment of the T&Cs
Nuvipil may modify these T&Cs for the future in order to take into account, in particular, legal, regulatory, technical, or commercial developments. The version enforceable against an order is the one brought to the Client's attention at the time of concluding the contract. A subsequent modification does not retroactively change the rights and obligations arising from an already concluded order, unless a mandatory legal provision states otherwise.
26. Partial invalidity
If any stipulation of these T&Cs is declared void, unenforceable, or unfair, the other stipulations remain applicable to the extent they can exist independently. The relevant stipulation is deemed unwritten or applied within the limits permitted by law.
27. Withdrawal form
The form below may be used when the right of withdrawal is applicable. Its use is not mandatory: any unambiguous statement expressing the desire to withdraw may be used within the legal timeframe.
